TERMS AND CONDITIONS OF RESIDENCY
1. It is imperative that you bring it to our attention if you not a full-time student, or are attending a part-time course, or intend to claim Housing Benefit.
2. You may arrange to view any property of your choice without obligation. Once you fill in an application form, we assume that you intend to proceed with the completion of a letting agreement. A £15 administration fee and deposit (see rental tariff) will be charged on application. Once the tenancy agreements are complete the administration fee will be offset against your compulsory personal contents insurance and our related administration costs. Please note that should you decide not to proceed to let a room the administration fee and deposit is non refundable. The property is let on an Assured Shorthold Tenancy for a 42 week period. (NB: Tenancies on one and two bedroomed flats are for 52 weeks.)
Applicants with an unconditional offer who do not get their grades will be refunded the deposit upon written confirmation from the University that they have not been offered a place on the course.
3. If you are unfamiliar with the law and your legal obligations in relation to the proposed tenancy, you should seek advice from a Solicitor, Accommodations Officer or Citizens Advice Bureau. When you sign the tenancy agreement we assume you are fully aware of your legal obligations. Keys will not be issued until the tenancy agreement has been fully completed. You must remain in the room for which you are contracted, changing rooms is forbidden.
4. A deposit is required to secure the accommodation. The deposit will be refundable at the end of the tenancy if you have given us a copy of your Council Tax Exemption Certificate and provided the property is left clean, damage free and in the same condition as at the commencement of the tenancy. (E.g. charges will be deducted for marks made by blu-tac, nails etc). The tenant will be responsible for all charges incurred for cleaning and damage in their own room plus a percentage of the charges incurred for the same in the common areas. Any repairs for damage caused during the course of the tenancy will be charged to the persons concerned for immediate settlement. The deposit only becomes refundable at the end of the tenancy. Therefore, if the main agreement is not completed, we will consider the deposit as payment in lieu of our expenses already incurred.
5. Rental is paid by post-dated cheques, termly, in advance. See tariff for details. Tenancy agreements will not be completed by the Landlord until all post-dated cheques are to hand. These may be provided by the student or by the guarantor at the time of signing. If necessary the Landlord will have no objection to holding individual cheques in the event of grant/loan payments being delayed. We simply ask that at least 48 hours notice is given if you do not wish us to bank your cheque until a later date, please ensure that you are given a reference number and a new date. We therefore suggest that a diary note is made of the new date and reference number. The tenant will be liable for all bank charges incurred by the Landlord if the cheques are returned etc. The tenant is expected to reimburse the Landlord for any charges upon demand.
6. A Parent or legal Guardian resident in the U.K. must stand Guarantor. The Guarantor is legally bound to pay any debts accrued during the tenancy if the tenant refuses to pay. Overseas Students who cannot provide a Guarantor please refer to the payment tariff.
7. The Tenant is responsible for the rent for the full duration of the 'term' i.e. 42 weeks (N.B. tenancies for one and two bedroomed properties are for a ‘term’ of 52 weeks), whether or not they reside in the property. If the tenant wishes to terminate their tenancy, notification must be submitted in writing. We will endeavor to find a new tenant who is acceptable to us and who is prepared to meet the financial and legal requirements of the tenancy agreement. Please note that you will be liable for all our administration charges incurred in assigning the tenancy. We cannot guarantee to find another tenant, obviously this becomes more difficult as the academic year progresses, and you will be liable for the rent until a new tenant is found or until the end of the tenancy (which ever is sooner). The tenant is at liberty to suggest their own replacement.
8. Tenants can raise no objection in relation to the Sex, Race or Religion of other persons resident in the property.
9. All bedrooms will be furnished but bedding (sheets, duvets, pillows etc.) is not provided. The lounge area will be furnished with easy chairs and a dining table. In the kitchen there will be a fridge/freezer, electric cooker and vacuum cleaner. Small electrical appliances and kitchen utensils (crockery, cutlery, pans, kettles etc.) are not provided. Chip pans and deep fat fryers which are not thermostatically controlled are forbidden. The use of candles is also forbidden.
10. The common areas will be inspected every month to ensure a good standard of hygiene is being maintained. Kitchen surfaces, floors and bathrooms must be cleaned regularly. If the premises are dirty cleaners will be instructed to visit. Tenants (and in turn the guarantor) will be responsible for all charges incurred. Please note these charges will be payable upon demand and not at the end of the tenancy. We will only require access to bedrooms in the event of an emergency or should we feel that the terms of the tenancy agreement are being abused.
11. The tenants are responsible for all charges in respect of the TV licence. It is the user of the TV who is responsible for the licence; this is not included in the rent.
12. If not included in the rental, the tenant will be jointly responsible with the other tenants of the property, for all charges in relation to the property including gas, electricity, telephone and water rates where applicable. At the beginning and end of the tenancy we will notify Gas, Electric and Water Utilities of the date of occupancy, names and HOME addresses of all tenants and the meter readings. However please note that we cannot be held responsible for any requests they may make with regard to such matters as deposits, guarantors, types of meter etc. Water charges will be payable to the landlord on demand.
13. Where there has been any breach of the Tenancy Agreement by the student or where fees have not been paid in accordance with the agreement or where any student causes nuisance or annoyance to fellow students or refuses to follow the reasonable direction of the management, The Landlord or their agents reserve the right to seek eviction of the tenant but without prejudice to any obligations which the tenant may be under by virtue of the agreement. Downing Property Services Ltd will also notify the relevant University who may take action under its Disciplinary Code in accordance with the Student Charter and its Code of Conduct.
15. Bedrooms are for single occupation only. Occasional overnight visitors will be allowed provided that no disturbance or inconvenience is caused to other occupants. Tenants will be held fully responsible for the actions and behaviour of their visitors.
16. Contents insurance is provided by Endsleigh Insurance – All enquiries with regards to insurance must be directed to Endsleigh on 0200 028 3571
